Extension of Filing of 2019 Income Tax Returns (ANNEX A-BIR MC 28-2020)
We are pleased to share with you the Bureau of Internal Revenue’s (BIR) Memorandum Circular 28-2020.  We gratefully acknowledge the positive response of the Department of Finance (DOF) and the Bureau of Internal Revenue (BIR) on our request to extend the filing of the 2019 Income Tax Return (ITR) due on April 15 to May 15, 2020, without the imposition of penalties, and the filing of corresponding taxes to any Authorized Agent Banks nearest the taxpayer’s location.
At the same time, we enjoin “those ready to file their ITRs on or before the original April 15 deadline to do so, in order to help the Duterte administration raise enough funds for the scaled-up national efforts to slow the spread of the novel coronavirus known as COVID-19.”
As the DOF explains, “An unintended result of the deadline extension is an estimated delay and shortfall in tax collections of around P145 billion, which may have to be covered by additional borrowings by the national government.  The government is thus appealing to those who are able to file within the deadline or even as early as now to do so through mechanisms that have been made available by the BIR, including online filing and payment platforms.
At this time when social distancing is being implemented, we further enjoin you to comply with your tax obligations using the Electronic Filing and Payment Systems (eFPS) and pay the corresponding taxes online through:

  • Land Bank of the Philippines’ (LBP) Link.Ziz Portal

  • Development Bank of the Philippines’ (DBP) Pay Tax Online

  • Union Bank Online Web and Mobile Phone Payment Facility

  • Mobile Payment (GCash/Paymaya)

Extension of Filing of VAT Refund and Ninety-Day Processing Period (ANNEX B-BIR MC 27-2020)
BIR likewise extended the Deadline for the Filing for VAT Refund and Ninety (90) Day Processing Period pursuant with the following guidelines:

  • Filing of VAT refund application covering the quarter ending March 31, 2018 can still be accepted until April 30, 2020

  • The 90-day period of processing of VAT refund claims by the processing offices for those claims are currently being evaluated and for those that may be received from March 16 to April 14, 2020 is suspended and that the counting of the number of processing days shall resume after the lifting of the community quarantine issued by the President.

Conduct of Audit and Other Field Operations (ANNEX C-BIR OM 20-2020)

Also note BIR’s Operations Memorandum 20-2020, which is suspending field audits/investigations, any form of business visitation and any other field operations (OPLAN Kandado, etc.) and temporarily prohibiting personal services such as Letter of Authority, Notice of Informal Conference, Discrepancy Notices and Mission Orders during the quarantine period.
Guidelines on the Movement of Cargoes and People in the Entire Luzon (ANNEX C: DTI MC 20-06)
The Department of Trade and Industry (DTI) issued Memorandum Circular 2020-06 prescribing the guidelines to “Ensure the Unhampered Movement of Cargo and Movement of People of Business Establishments Exempted from the Home Quarantine Requirement.”
The order covers businesses engaged in the production, processing, distribution, delivery and supply and disposal of medicine and medical supplies, food and other essential products; export and business process outsourcing (BPO) and retail establishments (groceries, supermarket, hypermarkets, convenience stores, pharmaceutical and drug stores.
ECOP Webinar on DOLE’s Adjustment Measures Program
Meanwhile, pursuant to our Advisory dated 18-March, on the Guidelines on COVID 19 Adjustment Measures Program for Affected Workers, the Employers Confederation of the Philippines’ (ECOP) is organizing a webinar on March 20, 2020 at 1:00PM.  The webinar aims to provide businesses a more detailed information on how they can avail of the financial assistance for their workers.
